• AI-generated insights and reports
• Subscription-based access to advanced features

3. User Accounts

3.1 Account Creation

• You must create an account to access certain features
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information during registration
• You must be at least 13 years old to create an account

3.2 Account Security

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Payments

4.1 Plan Types

We offer multiple subscription tiers:

• Free Plan: 2 videos (lifetime limit)
• Starter Plan: Monthly subscription with specific limits
• Creator Plan: Enhanced features and limits
• Pro Plan: Advanced features, no ads
• Studio Plan: Premium features, no ads
• Custom Plan: Enterprise solutions

4.2 Billing

• Subscriptions are billed monthly in advance via Stripe
• All prices are in USD unless otherwise stated
• Payment must be received before service activation
• We do not store credit card information on our servers

4.3 Upgrades and Downgrades

• You may upgrade or downgrade your plan at any time
• Upgrades are effective immediately with prorated billing
• Downgrades take effect at the end of the current billing period
• Downgrading to the Free plan cancels your paid subscription

4.4 Refunds and Cancellations

• You may cancel your subscription at any time
• Cancellations take effect at the end of the current billing period
• No refunds for partial months or unused service
• Free plan users may cancel without financial obligation

5. Content Ownership and Usage Rights

5.1 Your Content

• You retain all ownership rights to videos you upload
• By uploading content, you confirm you own or have rights to use it
• You grant us a limited license to process your content solely for service provision
• We do not claim ownership of your uploaded content

5.2 Content Restrictions

You agree NOT to upload content that:

• Violates intellectual property rights
• Contains illegal, harmful, or offensive material
• Promotes violence, discrimination, or hate speech
• Contains malware or malicious code
• Violates any applicable laws or regulations

5.3 Content Deletion

• Videos are automatically deleted from our servers after 30 days
• We reserve the right to remove content that violates these terms
• Users can request immediate deletion of their content

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any illegal activities
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots) to access the Service
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without authorization
• Share account credentials with others

7. Service Availability and Limitations

7.1 Service Level

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions beyond our control

7.2 Usage Limits

• Each plan has specific limits on videos, frames, and video length
• Exceeding plan limits may result in service restrictions
• Usage resets monthly (except Free plan lifetime limit)

8. Intellectual Property

8.1 Our IP

• All Service code, design, and AI models are our intellectual property
• VideoSenseAI name, logo, and branding are protected trademarks
• You may not use our IP without written permission

8.2 Generated Reports

• AI-generated analysis reports are licensed to you for personal or business use
• You may not resell or redistribute reports as a standalone product

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Key points:

• We do not use your videos to train AI models
• Videos are processed securely on Hetzner servers
• Personal data is encrypted and protected
• You can request data deletion at any time

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of AI analysis results

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for third-party services (Stripe, Hetzner)
• You use the Service at your own risk

12. Indemnification

You agree to indemnify and hold harmless VideoSenseAI from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service

13. Termination

13.1 By You

• You may terminate your account at any time through account settings
• Cancellation takes effect at the end of the billing period

13.2 By Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Payment fails repeatedly
• Required by law

14. Changes to Terms

• We may update these Terms from time to time
• Continued use after changes constitutes acceptance
• Material changes will be notified via email or Service notification
• You should review Terms periodically

15. Governing Law and Disputes

• These Terms are governed by applicable international laws
• Disputes will be resolved through binding arbitration when possible
